This agreement is between you, as a contractor, and HomeBackupPros, a North Carolina trust, acting by its trustee ("we"), which operates HomeBackupPros. It adds to the terms of service. You sign it when you create a contractor account by typing your name, and section 9 makes the loser of any dispute between us pay the winner's attorney fees.
1. You run your own show
You are an independent individual or business. You choose which jobs to quote, set your own prices, choose whether to charge a flat price for the job or an hourly rate, decide how and when to do the work, and supply your own tools and transportation. HomeBackupPros does not supervise, train, schedule or direct you, and you are not our employee.
2. Taxes, licenses, permits and local rules
You are responsible for your own taxes, business registrations, and any permits or licenses your work requires. You are also responsible for the laws and local rules that apply to each job: NC licensing, permits and inspections, utility interconnection applications, HOA rules the customer tells you about, and lawful disposal of old equipment. Dispose of anything you haul away only where it is allowed. HomeBackupPros does not check or enforce these rules for you.
3. Insurance
Report your insurance honestly and keep it current. We recommend general liability insurance for every job. You must carry general liability insurance to quote through HomeBackupPros. Workers' compensation is your responsibility wherever the law requires it.
4. Safety limits
Through HomeBackupPros the following is not allowed: electrical, roof or structural work without the licenses, permits and inspections it requires, or work that does not meet the North Carolina State Building Code. Follow your state's price gouging laws during declared emergencies.
5. Quotes and showing up
Quote only jobs you intend to do. When a customer accepts your quote, contact them promptly and show up when agreed. If plans change, tell the customer as early as you can. Customers can report no-shows, and reaching the no-show limit suspends your account automatically.
6. Customer information
Use a customer's contact details only to arrange and do the job they hired you for. Do not share them or add them to marketing lists.
7. Fees
Joining and quoting are free right now. If we introduce a fee for contractors, we will tell you in advance and show the amount before you are charged. We may show labeled offers for insurance, tools and business services, some from businesses affiliated with the people behind HomeBackupPros, and we may be paid if you use them. You never have to.
8. Your responsibility
You are responsible for your work and your conduct. If a claim arises from work you performed or from breaking this agreement, you agree to cover our reasonable costs of dealing with it, to the extent the law allows.
9. Attorney fees
This is a business contract between you, as an independent business or self-employed individual, and us. In any dispute between you and us about this agreement, the terms of service or your work through the site, the losing side pays the winning side's reasonable attorney fees and costs, as decided by the arbitrator or court. This applies equally to both of us and is intended to be enforceable under North Carolina General Statute 6-21.6. For a claim brought by or against a customer, the terms of service control instead.
10. Ending the relationship
Either side can end this agreement at any time. You can close your account by emailing help@homebackuppros.com. We may suspend or remove accounts that break this agreement or put customers at risk.
11. Signatures
You sign this agreement by typing your full name in the signature box at sign-up and checking the box that says you agree. That typed name is your electronic signature under the North Carolina Uniform Electronic Transactions Act, and we keep a record of it with the date, time and agreement version. We sign below by electronic signature. The disputes and arbitration section of the terms of service applies to this agreement, except that section 9 above decides attorney fees between you and us.

Additional terms for solar, battery and generator contractors
You confirm that you, or the business you sign up for, hold an active North Carolina electrical contractor license of the class your work requires, and any other license the job needs, and you will tell us within 7 days if a license lapses, is suspended or changes class. You will pull the permits and arrange the inspections each job requires and follow your customer's utility interconnection rules.
If you offer the standard home energy evaluation you will do it for the price shown on the site, leave the customer a written quote, and credit that price toward the system if the customer buys the system from you. Failing to credit it is a breach of this agreement and grounds for removal.
You will not describe yourself as endorsed, ranked or recommended by us. A listing is not an endorsement. You will use a customer's contact details only for that customer's project and will not sell, share or add them to marketing lists.
